Sales and Contracting Conditions
These Conditions regulate the use of the web platform www.greenwichnautica.es, for which Greenwich Learning, S.L., hereafter referred to as “Greenwich Náutica,” is the legal responsible entity. By accepting, the User states that they have read, understood, and comprehend what is set forth here and that they assume all obligations. If the User does not agree with the content of this document, they must leave this website, as they may not access or use the services it offers. Likewise, the User expressly accepts without exceptions that the access and use of this website, its services, and the contents of these services take place under their sole and exclusive responsibility. These Conditions will be accepted by the parties without reservations and may be modified at any time and without prior notice, being the User’s responsibility to read them when making a purchase or contracting. The conditions in effect at the time of entering into the contract will be applicable.
User Registration and Error Correction
To use the services offered on the web, contracting through the platform itself is necessary, as explained in the “Service Contracting” section; following this, the license of use will be activated, they will be registered on the platform, and access keys will be provided. From the User account, one can access the personal user area, where you can edit personal information, change passwords, carry out other procedures or manage related to your contracts, and if necessary, correct any errors that may have occurred in the introduction of the data (or update them). By registering, the User commits to using this service only for private purposes and not for commercial purposes, unless expressly consented by the Responsible party of this website.
Courses
Upon purchasing a course, and after payment, the User will have access to the private area of “Greenwich Náutica,” where they will find access to the courses in which the student has enrolled. The User will have 6 months of access to the virtual campus from the moment the course fee is paid. After that time, access to the course and all its content will be lost. If necessary, a temporary extension of access to the content (up to a maximum of nine months) may be granted, which must be requested and justified at least 1 month in advance of the end of the contracted course. We will provide the educational material in electronic format along with the instructions to access our online school. This material is included in the price of the course. It is necessary to have a computer, tablet, or smartphone with an Internet connection to properly follow the course. The user commits to using this service only for private purposes and not for commercial purposes. “Greenwich Náutica” commits to hiring the most suitable qualified teaching staff available for teaching the classes of each course. Greenwich Náutica reserves the right to change the teaching staff during the course. Changing teachers during the course will not result in a refund to the User.
Make-up Classes
If you cannot attend a class, you can make it up by attending on another day in any of the available groups, provided there are free spots in the group and it is informed in advance. If you cannot make up the class, it is possible to watch an online recording of the missed class. All national or local holidays and holidays published by Greenwich Learning SL on the website www.greenwichnautica.es will be considered non-teaching days for the courses. If Greenwich Náutica needs to cancel a class, this class will be made up at the convenience of both parties.
Changes to Practical Classes
Once the reservation is made, you can change the date and time of your course up to 10 days in advance of the scheduled day.
Adverse Weather Conditions
Practices may be cancelled when weather conditions advise it, at the discretion of the captain or responsible instructor, or due to force majeure. In case of cancellation, you will have the right to reserve another available date. If the practice is suspended having made some of the outings, new outings will be scheduled. In the described cases, you will not have the right to compensation.
Delays
In case of delays in reaching the destination port due to adverse weather conditions or other causes of force majeure, you may disembark at another port, taking care of all expenses arising from your return to the place of origin and without the possibility of receiving compensation.
Minimum Number of Students
Greenwich Náutica reserves the right to cancel or merge groups if the number of students is less than 50% of maximum capacity. When a group does not meet the minimum number of students, the School will offer you one of the following alternatives: attend another group (in-person or remote), take the course on other dates, start the course adjusting the prices to the participation of fewer students or the total refund of the amount paid.
Guaranteed Pass (Online Courses for PNB, PER, or Yacht Captain)
In case the student does not pass the exam, they may extend access to the virtual campus for a further six months free of charge, provided the following conditions are met: (a) They have enrolled in an exam corresponding to the course in which they have enrolled; (b) They have attended the exam. (c) They have accessed the Greenwich campus and completed the corresponding online course according to the conditions set by our teachers. To benefit from this condition, you must request the guaranteed pass within 30 days following the publication of your grade. If the conditions of the guaranteed pass are not met, the student may repeat their course paying a reduced amount of 50% of the current rate.
Service Contracting
To use the educational platform, the system requires the contracting of a paid course. The courses available, along with their main features and prices, can be found at the following URL: https://greenwichnautica.es/
1. Select the courses you wish to purchase from those offered by “Greenwich Náutica.” By clicking on each course, you access its file, which includes a detailed description with information, main characteristics, and price. If you need more information, do not hesitate to ask us.
2. Once you have selected the course(s) you wish to purchase, you must press the “Buy now” button. You must select from the available dates the desired start date.
3. To finalize the contracting, you must register, indicating your contact details and whether the purchase of the course is for yourself or for a third party.
4. Finally, you must accept these Contracting Conditions and choose the payment method from those offered by “Greenwich Náutica” (see next section).
5. Once the contracting process is completed, we will send you an email detailing the transaction data, as well as a receipt or invoice. If you do not receive this email within 24 hours, or if you notice any errors in the data entered, please contact us by any of the following means:

Likewise, if you have not given your consent for us to send you the invoice in electronic format, you will receive a paper copy at no additional cost. Otherwise, you can revoke your consent by contacting us by any of the aforementioned means.
By contracting the service, an electronic contract is formalized, held under Spanish regulations, specifically under the legal regime imposed by the Law 34/2002, of July 11, on Services of the Information Society and Electronic Commerce (LSSICE) and by the Law 03/2014, of March 27, General for the Defense of Consumers and Users (LGDCU).
The electronic contract will not be filed by a third party, and the language for its conclusion is Spanish. These Conditions may be saved and reproduced at any time by the User making a contract using their internet browser options, and must be accepted before proceeding to the payment of the services.
Responsibility
At “Greenwich Náutica,” we will NOT be responsible for the damages you have suffered as a result of non-compliance with these Conditions if such damages are not foreseeable by us, nor will we be responsible for indirect damages (such as lost profits, loss of enjoyment, or opportunity). These limitations do not apply to the extent that applicable legislation does not allow it.
The User expressly exempts the school and the instructor from physical or material damages that may occur, as a result of personal circumstances not assessable by the school such as pregnancy, diabetes, hypertension, epilepsy, or any other medical contraindication, fully assuming the User, the risks that navigation entails for their health.
Payment Methods
“Greenwich Náutica” offers various payment modalities:
– Bank transfer
– Credit or debit card
Below, we specify the conditions for each of these payment methods.
Bank transfer
You can make the payment via a transfer to our bank account. If you choose this payment option, once the process is completed, the necessary data to make the bank transfer will appear on the screen. Additionally, we will send you an email with the amount, the concept you must indicate, and the account number. Keep in mind that transfers can take up to 48 hours to be effective. If you want to speed up this process, you can send us an email with the proof to cursos@greenwichnautica.es.
If the reflected amount is not paid, the contracting will not be processed, and it will be without effect.
Credit or debit card
Payment by credit or debit card is made through the secure payment gateway of Stripe. With this payment modality, “Greenwich Náutica” never collects or handles any customer data related to their card number. All data is treated directly by Stripe, so that “Greenwich Náutica” can always offer the highest security, transparency, and confidentiality in the transaction.
Prices, Taxes, and Fees
The prices of the services and plans are established in the rates section of this website, or in the file corresponding to each service. They are expressed in Euros.
The final price of the contracted services may vary depending on the applicable taxes in each case, or depending on the address and profile of the buyer (individual or professional)., except in those activities not subject to or exempt from VAT, the following taxes will apply on our website:
The following taxes will apply to the services offered on our website:
– The PVP of the services provided to clients with a billing address in the Peninsula and Balearic Islands includes VAT in any case.
– The PVP of the services provided to clients with a billing address in other EU countries, and being the buyer an individual (private) includes the VAT corresponding to the country of the service provider.
– The PVP of the services provided to clients with a billing address in other EU countries, and being the buyer a company or professional, does NOT include VAT in the case of being registered in the ROI (Register of Intra-community Operations). Otherwise, the price service will include the VAT of the country of the service provider.
– The PVP of the services provided to clients with a billing address in the Canary Islands or Ceuta and Melilla, and, in general, any country that is not from the EU, does NOT include VAT, as the operation is treated as an export. The price indicated for each service is the final price of the same.
Account Cancellation and Service, Cancellation, and Blocking
User accounts are not deleted due to lack of use. The User can unsubscribe by requesting the same to the staff of “Greenwich Náutica,” sending an email to cursos@greenwichnautica.es or through their account profile.
The service will remain active as long as the amounts accrued for its use are paid on time and in form. In case of cancellation of the service during a period by the User, no refund will be made for the unused time.
In case of non-payment of the service, it may be temporarily suspended until the non-payment situation has been resolved by the User. If more than 15 days pass, the service will be canceled, a situation that does not exempt the User from paying for the proportional part of the service that they have been able to enjoy before its suspension.
“Greenwich Náutica” reserves the right to block without prior notice the access to the service (or directly delete the User account), if it is used in an illegal manner, fails to comply with the obligations and rules established here, or misuses the application, a fact that will be communicated by email. The blocking or deletion of the User account will have no effect on the obligation to pay for the service acquired if it has already been provided, if applicable.
In exceptional cases, at the discretion of the administrators of “Greenwich Náutica,” and assessing the severity of the fact, the administrators may choose to warn the offending user before permanently deleting or blocking their account.
By registering as a User, you agree that the owners of this site reserve the right, and may act at any time and without prior notice, to modify or discontinue this website and its services, or delete data provided, either temporarily or permanently.
Returns
At “Greenwich Náutica,” we want you to be satisfied with the services contracted with us. Therefore, we provide you with the option to cancel them if they do not meet your needs or expectations, according to the established in the LGDCU. The exercise of the right of withdrawal must be made within a maximum period of FOURTEEN (14) calendar days from the contracting. You must notify us, through the email cursos@greenwichnautica.es, of your decision to withdraw from the purchase made (you may use the following model withdrawal form if you wish).
To exercise this right, the service must not have started. If it has started, we will only return the proportional part of the services not provided, provided that such distinction or segregation is possible.
We remind you that, by regulation, this right cannot be exercised over services with a deadline (for example, tickets, plane tickets…), or digital products/services when downloading or use has already started, unless specifically indicated that possibility.
The refund of the purchase amount will be made once the contracting status has been checked, through the same payment method used in the purchase and, in any case, before 14 calendar days have elapsed since the reliable reception of the withdrawal request. The costs arising from the exercise of the right of withdrawal will be borne by the buyer.
Dispute Resolution
As required by the new European regulations, we inform users of the existence of a European platform for resolving disputes for online contracts.
